PINK PENGUIN INSTAGRAM COMPETITION T & Cs

TERMS & CONDITIONS

1)         This Promotion and Competition is run by the McGrath Foundation Ltd (“the Foundation”) of Level 1, 115 Sailors Bay Road, Northbridge NSW 2063 (ABN 23 115 566 624).

2)         Information on how to enter forms part of the terms and conditions of entry. Entry into the competition is deemed acceptance of these Terms and Conditions.

3)         Entry is open to all permanent residents of Australia. Employees and their immediate families of the Foundation and their agencies and companies associated with the promotion are not eligible to enter.

4)         The competition commences on 21st May 2013 at 00:01am (EST) and concludes on 18th June 2013 at 23:59pm (EST)(“the Promotional Period”).

5)         To enter participants must:

a)         Post a photo on Instagram of the most creative photo featuring their “Pink Popular Penguin”

b)         Tag @mcgrathfoundation in the caption and hashtag #mcgrathfoundation

c)         The most creative entries will go in the draw to win.

6)         Entrants warrant that they have complied with the Instagram Terms of Use as published on the Instagram website.

7)         Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.

8)         Incomplete or incomprehensible entries will be deemed invalid.

9)         The Prize (valued at up to $119.40 in total) is 1 complete set of 12 Pink Penguin books inclusive of the below titles:

10)       Additionally twelve Entrants will receive 1 individual Pink Penguin Book of the 12 book series. The selection of which individual Pink Penguin Book will be made randomly and at the complete discretion of the Foundation.

11)       Each valid entrant who has entered the competition during the promotional period will be entered into the draw. Thirteen valid entries will be drawn at random to become the winning entries, with the first drawn entry the winner of the complete set of Pink Penguin Books, and the following twelve drawn entries each winning a Pink Penguin book.

12)       Prizes will be awarded to the person named as sole owner of the Instagram account. Prizes cannot be transferred or redeemed for cash. If a competition winner is under 18 years of age the prize will be awarded to the winner’s parent or legal guardian.

13)       The Foundation will not enter into any correspondence regarding the competition result.

14)       The Foundation reserves the right to disqualify any person who the Foundation has reason to believe has breached any of these conditions, the Instagram Terms of Use or engaged in any unlawful or improper misconduct which may interfere with or is calculated to interfere with,  the fair and proper conduct of this Promotion. The Foundation’s legal rights are reserved to recover damages or other compensation from such an offender.

15)       If for any reason this promotion is not capable of running as planned, including (but not limited to) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Foundation, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Foundation reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under state permit regulations.

16)       In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state legislation.

17)       The draw for the winners will take place on 18th June 2013 at 12pm (EST) at the Foundation’s offices – Level 1, 115 Sailors Bay Road, Northbridge, NSW, 2063. If the winners are under the age of 18 years the prizes will be awarded to their parents or legal guardians.

18)       Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars.

19)       The Foundation reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter.

20)       Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

21)       All winners will be notified by instagram or email within 2 days of the winners being decided, and the winner's details will be published on the Foundation's website on 20th June 2013. A list of all prizes and winners will be displayed in a prominent place on the Foundation's website (www.mcgrathfoundation.com.au) and at the Foundation's premises for 7 days after the date of the draw.

22)       The Foundation shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained in connection with any prize/s, except for any liability which cannot be excluded by law.

23)       Subject to any direction which may be given under the relevant State legislation, the Foundation will conduct such further draws as may be deemed necessary at the Foundation’s offices – Level 1, 115 Sailors Bay Road, Northbridge, NSW 2063 on 2nd July 2013 at 12pm (EST) to distribute any prizes unclaimed by that date, and published on the Foundation's website on 4th July 2013. If any prizes remain unclaimed for 3 months, the Promoter will draw another winner.

24)       The Foundation collects personal information about you to enable you to participate in this promotion. To facilitate your participation, the Foundation may disclose your personal information to other companies associated with this promotion. An entrant’s personal information may be disclosed to State and Territory lottery Departments and winners’ names published as required under the relevant lottery legislation. No other further use of this information will be made without your prior consent. A request to access, update or correct any information should be directed to the Foundation at Level 1, 115 Sailors Bay Road, Northbridge NSW 2063.

25)       The Foundation accepts no responsibility for any kind of loss or liability suffered or incurred by any of the prize-winners in relation to the prizes or the promotion. The winners release the Foundation its related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize or the promotion. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the prizes.

26)       The Foundation will make reasonable effort to locate the winners and deliver the prizes within 14 days after the winners are decided

27)       Once prizes have left Foundation's premises, the Foundation will not be responsible for any delay in delivery, or failure of safe delivery of prizes. The Foundation will take no responsibility for prizes damaged in transit.

PEDALLING PINK FOR A CURE

The team at the McGrath Foundation was really concerned to hear the news about an incident in Rollingstone, QLD, that occurred on Wednesday (15 May) involving a member of the community event team raising funds for the McGrath Foundation, ‘Pedalling Pink for a Cure’.

 

Our main concern is for the welfare of the injured crew member, his family and the broader community event team who are part of the ride.  As such, we will do everything in our power to support the team up in Townsville and to help them through this terrible situation.

 

The McGrath Foundation will remain in constant contact with the team to provide them any assistance we can as well sending all of our love and thoughts their way.

PINK PLATES RAISE $250,000 FOR BREAST CARE NURSES

 NSW motorists adding a splash of hot pink to their vehicles have been doing their bit for cancer support, with more than $250,000 raised for the McGrath Foundation through the sale of pink and prestige number plates.


NSW Premier Barry O’Farrell today handed over a cheque to McGrath Foundation chairman Glenn McGrath from the latest RMS rare number plate auction, where a pink ‘56789’ plate raised $26,000. 
“Pink plates are proving a popular choice for NSW motorists,” Mr O’Farrell said.


“Not only do they add a colourful and personal touch to vehicles, but each sale raises money for the McGrath Foundation.


“Since 2009, more than $250,000 has been raised through the sale of plates and specialty auctioned plates to support the McGrath Foundation.


“People are buying these plates because they want to show their support in a public and practical way - myPlates donates $15 to the McGrath Foundation for each pink plate sold and $50 for each prestige plate.


“The NSW Government is proud to support this initiative and values the work of McGrath Breast Care Nurses in the community who have supported over 20,000 Australian families through their breast cancer experience.”


Chairman and Co-Founder of the McGrath Foundation, Glenn McGrath, said the Foundation is getting one step closer to their goal of 150 McGrath Breast Care Nurses thanks to motorists choosing pink myPlates.


“The McGrath Foundation aims to ensure every family experiencing breast cancer in Australia has access to a breast care nurse, no matter where they live or their financial situation.  “We’re so proud of our friendship and thank RMS and myPlates for making it easy for people to support our Foundation by sporting pink plates, just like I have on my car.  “This month, RMS and myPlates even restyled 16 of our 22 NSW McGrath Breast Care Nurses’ number plates to pink plates to make them more recognisable in the community,” Mr McGrath said.


In February 2013, $26,000 was raised in the RMS rare number plate auction, with a pink ‘56789’ plate catching the eye of a bidder keen to support the McGrath Foundation.  Mr ‘Pink Plate’, an anonymous long term fan of number plates said he made the big purchase in honour of his wife Elizabeth’s mother who lost her life to breast cancer.


“I made numerous phone calls to the RMS and was determined to buy the number plate. I was lucky enough to take it home in honour of a woman we took care of who sadly didn’t make it, so this was definitely the right thing to do,” he said.


The sale of rare number plates at RMS auctions has raised more than $3.57 million since 2009 towards RMS road safety and maintenance upgrades, with over $1 million raised alone at the auction on 4 February.


The record for an Australian number plate bought at auction is $680,000 which was paid for ‘NSW 2’ in 2003.

TERMS & CONDITIONS

Participation in the Pull on Your Socks Promotion

1)         The “Pull on your Socks Promotion” (“the Promotion”)  is run by the McGrath Foundation Ltd (“the Foundation”), a registered charity, of Level 1, 115 Sailors Bay Road, Northbridge NSW 2063 (ABN 23 115 566 624).

2)         The Promotion is a fundraising appeal to be conducted by the Foundation via its website and that of Go Fundraise http://pullonyoursocks.gofundraise.com.au, commencing on 3 April 2013, in all States to raise funds for the benefit of the Foundation.

3)         The Entrant agrees to:

    a)         provide registration details and submit these through GoFundraise: http://pullonyoursocks.gofundraise.com.au (which can be accessed through a link from the Foundation website: www.mcgrathfoundation.com.au) ;

    b)         outline in 50 words or less why women are important to your team or club (“the Entry”);

    c)         make the Donation to the Foundation; and

    d)         be bound by these terms and conditions.

5)         The Foundation accepts no responsibility for any kind of loss or liability suffered or incurred by any of the Entrants in relation to the Promotion. The Entrants release the Foundation, its related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in the Promotion. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the Promotion.


Definitions

Competition means the determination of eligibility to win a prize in a number of categories, as follows:

·         Competition Category 1 - If a registered Entrant remits a Donation to the Foundation of $1 or more, within the prescribed time period and in accordance with these Terms and Conditions, the Entry submitted by that Entrant will be included in the Judging to win one of the following Prizes:

o    10 Steeden Pink McGrath Foundation “Replica” Footballs (valued at $40 each);

o    One signed 2012 Australian Kangaroos Jersey

o    One signed 2012 NSW State of Origin Players’ Jersey

o    One signed 2012 NRL Melbourne Storm Jersey

o    Two Sony DSCH90B Digital Cameras (valued at $299 each).

 

·         Competition Category 2 - If a registered Entrant remits a Donation to the Foundation of $1000 or more, within the prescribed time period and in accordance with these Terms and Conditions the Entry submitted by that Entrant will be included in the Judging to win the following additional Prize:

o    an appearance by an NRL One Community Ambassador, at a location nominated at the time of registration and a date and time convenient to both the Entrant and the NRL One Community Ambassador.

 

Donation means the money amount raised by an Entrant for the benefit of the Foundation and remitted to the Foundation.

Entrant(s) means the person, either on their own behalf or as an authorised representative of a Club or Association, submitting a registration to participate in the Promotion and thereby becoming eligible to participate in the Competition through the GoFundraise website http://pullonyoursocks.gofundraise.com.au.

Entry means the outline of 50 words or less giving reasons why women are important to the Entrant’s team or club, submitted by an Entrant as part of the registration process.

Foundation's Intellectual Property means the name, trademarks, logo and other intellectual property of the Foundation.

Foundation’s Website means (www.mcgrathfoundation.com.au)

Judging means the determination of which Entrant is to be awarded the prizes in Competition Category 1 and Competition Category 2 whereby Entries are judged on the basis of their creativity, by a panel comprised of McGrath Foundation staff.

Eligibility to participate in the Promotion

1)         The completion of details on a registration form to participate in the Competition submitted through the GoFundraise website (http://pullonyoursocks.gofundraise.com.au) is deemed acceptance of these Terms and Conditions.

2)         Entry is open to all Australian residents’ 18 years and over. Persons under the age of 18 are ineligible to entry.

3)         To enter Entrants must:

    a.         Log onto the website http://pullonyoursocks.gofundraise.com.au during the period 3 April 2013 to 31 July 2013 inclusive;

    b.         Complete a registration form with details of name, address, contact phone number and nominate the Club where if successful, the NRL One Community Ambassador would be required to attend;

    c.         outline in 50 words or less why women are important to your team or club;

    d.         make the Donation to the Foundation; and

    e.          be bound by these terms and conditions.

4)         The Entry period commences on 3 April 2013 at 10am (AEST) and concludes on 31 July 2013 at 11:59pm (AEST).

5)         Incomplete or incomprehensible entries will be deemed invalid.

6)          The cost of accessing either the Foundation or GoFundraise websites will be dependent on the Entrant’s individual Internet Service Provider.

7)         The Foundation reserves the right to disqualify any Entrant who the Foundation has reason to believe has breached any of these conditions, or engaged in any unlawful or improper misconduct calculated to interfere with the fair and proper conduct of the Competition. The Foundation’s legal rights are reserved to recover damages or other compensation from such an offender.

8)         If for any reason the Competition is not capable of running as planned, including (but not limited to)  illness, death, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Foundation, which corrupt or affect the ability of the NRL One Community Ambassador to attend or administration security, fairness or integrity or proper conduct of this Competition, the Foundation reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend  the Competition, subject to any direction given under applicable State fundraising legislation.

9)         In the case of the intervention of any outside agent or event which naturally changes or prevents the Competition draw or prevents or hinders its determination, including but not limited to illness, death, vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Foundation may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state legislation.

10)       The determination of prize winners will take place on 7 August 2013 at 12pm (EST) at the offices of the McGrath Foundation Ltd, Level 1, 115 Sailors Bay Road, Northbridge NSW 2063.

11)       Prize winning entries will be judged on the basis of their creativity, by a panel comprised of McGrath Foundation staff, in each of the Competition Categories as follows:

    a.     15 prize winning entries in Competition Category 1;

    b.    1 prize winning entry in Competition Category 2.

12)       Each valid Entrant who has registered will be considered in the determination of Prize winners in Competition Category 1 or 2 (as determined by the amount of the Donation remitted to the McGrath Foundation on or before 31 July 2013).

13)       The Foundation reserves the right to request the winner provide proof of authority to act on behalf of the Club or Association in arranging the attendance of the NRL One Community Ambassador. Such proof considered suitable for verification is at the discretion of the Promoter.

14)       All Prize winners will be notified by email and the winner's details will be published on the Foundation's website (www.mcgrathfoundation.com.au) within 2 business days of the Competition draw.

15)       The identities of the Competition winners will be displayed in a prominent place at the Foundation’s premises for 7 days after the date of the draw.

16)       The Foundation shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained in connection with any prize/s, except for any liability which cannot be excluded by law.

17)       Subject to any direction which may be given under the relevant State legislation, the Foundation will conduct such further draws as may be deemed necessary at the offices of the offices of the McGrath Foundation Ltd, Level 1, 115 Sailors Bay Road, Northbridge NSW 2063 on 1st October 2013 at 12pm (EST) to distribute any prizes unclaimed by that date (subject to state legislation), and published on the Foundation's website (www.mcgrathfoundation.com.au)  on 2nd October 2013. The winner of any such redraw will be notified in writing within 7 days of the redraw taking place.

18)       All Entries become the property of the Foundation. The Foundation collects personal information about you to enable you to participate in this Competition. To facilitate your participation, the Foundation may disclose your personal information to other companies associated with this Competition. An Entrant’s personal information may be disclosed to State and Territory lottery Departments and winners’ names published as required under the relevant lottery legislation. The Foundation may also use entrant information to contact you about news, events and general information in relation to the organisation. No other further use of this information will be made without your prior consent. 20)  The Foundation will make all reasonable effort to locate the winners and to have the NRL One Community Ambassador attend the Entrant’s Club.

21)  “The Promoter” is the McGrath Foundation Ltd of Level 1, 115 Sailors Bay Road, Northbridge NSW 2063 (ABN 23 115 566 624).

 Fundraising requirements

1)         The Entrant has no right or interest in the Foundation's intellectual property.

2)         Confirmation of Entry will be provided at the time the entry details are received by the Foundation.

3)         If for any reason this competition is not capable of running as planned, including (but not limited to) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Foundation, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Competition, the Foundation reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State permit regulations.
